How are progressive vacations calculated?

Article 68 of the Chilean Labor Code establishes the legal framework for progressive vacations in Chile.

Progressive vacation refers to a system in which the length of paid annual leave increases as an employee gains more years of service at the same company. At Wiseplan, we tell you the keys to properly calculating your employees' progressive vacation time, based on current legislation.

What are progressive vacations?

According to the Chilean Government's Labor Department website , the progressive vacation benefit consists of the right of all workers to add one day of vacation for every three years worked for their current employer, provided they have worked for 10 years (120 social security contributions) for their current or previous employers.

 

How to calculate your employees' progressive vacation time correctly?

  1. Have 10 years of work experience with your current or previous employers.
  2. Complete three more years with the current employer.
  3. Progressive vacation days are permanently added to the worker's annual vacation, increasing by one day every three years, provided that they do not change employers.
  4. If the worker changes employers, they will lose their accrued vacation days, and the time worked will only count toward completing the 10-year base period with the new employer.
  5. Only after completing three years of service with the new employer will you be entitled to a first day of progressive vacation time.
